Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using RageFit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

RageFit is a gamified accountability and screen-time discipline app that lets you:

• Create and track goals (manual goals and device-measured goals such as steps, focus timers, and screen time where supported)
• Receive notifications and in-app messages (including AI-generated "roasts") based on your goal performance
• Connect with friends for accountability (requests, rivals, messaging, leaderboards)
• Participate in challenges/events and earn virtual currency and rewards

Features may change over time (see Section 13).

3. Eligibility and Account Registration

• You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with a parent/guardian's consent.
• You must provide accurate account information and keep it up to date.
• You are responsible for maintaining the security of your account and for all activity under your account.
• One account per person (unless we approve otherwise).
• If you are between 13 and 17, a parent or guardian must consent to your use of the App, accepts these Terms and the roast content described in Section 6 on your behalf, and is responsible for any purchases made from your account.
• The App is not for children under 13. If we learn that an account belongs to a child under 13, we may close it and delete the associated data.

4. Permissions and Device Integrations

Some features require device permissions or system access. If you deny or revoke permissions, those features may not work.

Depending on your device and settings, RageFit may request access to:

• Notifications (to deliver accountability alerts and roasts)
• Usage / Screen-Time data on Android (e.g., UsageStats) for screen-time goals
• Motion/fitness data (e.g., pedometer/health integrations) for step/movement goals
• Other device features strictly needed for core functionality

5. User Conduct

You agree NOT to:

• Use the App for illegal purposes
• Harass, abuse, threaten, defame, or harm other users
• Send obscene, hateful, or sexually explicit content through social features
• Attempt to bypass security measures, RLS rules, rate limits, or access controls
• Create multiple accounts to gain unfair advantages
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law
• Upload or transmit malware or attempt to disrupt the App's operation
• Use the social features—including roasts you send to friends, hijack messages, motivational messages, rage relay, duels, and boss battles—to bully, intimidate, or pile on to anyone, or to keep sending content after being asked to stop or after being blocked
• Send content that attacks a person's race, ethnicity, religion, disability, gender, gender identity, or sexual orientation, or that encourages self-harm, disordered eating, or violence
• Use the App to monitor, track, or surveil another person, or install it on a device you do not own or are not authorized to use
• Buy, sell, trade, or transfer coins, gems, accounts, or challenge outcomes for real money or anything else of value

We may remove content and/or suspend accounts that violate these Terms.

5.1 Messages You Send to Other Users

• Roasts you send to a friend, hijack messages, motivational messages, and anything else you send through the App are your User Content. You send them in your own name, you are solely responsible for them, and you send them at your own risk.
• We do not write, review, or approve messages between users before they are delivered, and we do not endorse them.
• Some features let you send content that appears on someone else's screen. Only use them with people who have chosen to be your friend or rival, and stop if they ask you to.

5.2 Blocking, Reporting, and Enforcement

• You can block another user from their profile in the App at any time. You can report an AI-generated roast using the feedback option attached to it. For anything else, email us at ragefitftw@gmail.com.
• We look at reports as soon as we reasonably can, but we do not promise a particular response time or outcome, and we are not obliged to explain a decision.
• Depending on what we find, we may warn you, remove content, restrict or remove your access to social features, forfeit coins, gems, or challenge winnings, suspend your account, or close it permanently.

6. AI-Generated Content ("Roasts")

• The App uses AI to generate certain messages ("roasts") intended as humor and motivational accountability about productivity/discipline—not personal attacks.
• To generate roasts, we may send limited goal details such as goal name/description, goal type and frequency, success/failure status, failure context (e.g., missed deadline), and metric context (targets/actuals). For app-specific screen-time goals, we may include selected app identifiers (package names).
• AI output can be incorrect, inappropriate, or unexpected. You are responsible for how you interpret and use it.
• You may be able to disable or reduce AI content in Settings (where available).
• You can report an AI-generated roast using the feedback option attached to it in the App. For messages sent by other users, block them from their profile and email us at ragefitftw@gmail.com (see Section 5.2).
• No professional advice: The App and AI content are not medical, mental health, legal, or financial advice.

6.1 Roast Intensity and Your Wellbeing

• RageFit deliberately produces blunt, sarcastic, and sometimes crude content about your goals. By leaving Roast Mode on you are choosing to receive that content, and you can lower the intensity or turn it off in Settings at any time. The intensity you pick is your choice.
• Roasts are generated automatically. No person writes or reviews them before you see them, they are not aimed at you as a person, and they are not advice or an assessment of you.
• This style of humor is not for everyone. If roasts make you feel worse rather than more motivated— particularly if you are dealing with body image, disordered eating, low mood, or thoughts of self-harm—turn the intensity down, switch Roast Mode off, or stop using the App.
• The App is not a mental health service and cannot recognize a crisis. If you are struggling or thinking about harming yourself, please contact your local emergency number or a crisis support service where you live.
• To the maximum extent permitted by law, you accept the risk of offense, upset, or distress from roast content you have chosen to receive, and you agree not to bring a claim against us in respect of it. Nothing in this section affects the liability we cannot exclude (see Section 11.2).

7. Virtual Currency, Purchases, and Store Items

• RageFit Coins/Gems (or similar) are virtual items with no real-world monetary value and are not redeemable for cash.
• Virtual items may be earned or obtained through in-app purchases (where available).
• All purchases are final to the maximum extent permitted by law, except where refunds are required by applicable consumer laws or by the platform's policies (Apple/Google).
• We may modify pricing, rewards, and availability of virtual items at any time.

7.1 What Coins and Gems Actually Are

• Coins and gems are not property and not money. They are a limited, personal, revocable, non-transferable license to use a feature of the App, and they only exist inside your account.
• They cannot be sold, traded, gifted outside the App, moved to another account, or exchanged for cash, goods, or anything else of value, and accounts cannot be transferred.
• If your account is closed or deleted—by you or by us—any remaining balance is lost without compensation, except where a refund is required by law or by Apple's or Google's policies.
• We may correct, remove, or reverse balances obtained through a bug, an exploit, a chargeback, or a breach of these Terms.

7.2 Staking: Duels, Coffee Fund Challenges, and Rescue Pledges

• Some features let you put coins behind a goal—wagering coins in a duel, staking coins in a coffee fund challenge, or pledging coins to rescue a friend. These are accountability and entertainment features between users who choose to take part.
• This is not gambling: results depend on whether you and the other participants complete your goals, not on chance. Nothing staked or won has real-world monetary value, no prize is redeemable for cash or anything else of value, and there is no way to cash out.
• If you lose, the coins you staked are gone. Staked and lost coins are not refundable, including coins that were originally bought with money, except where a refund is required by law or by the platform's policies.
• Outcomes are decided from the data the App receives, which depends on your device, permissions, operating system, connectivity, and clock. To the maximum extent permitted by law we are not liable for a missed goal, lost stake, or lost duel caused by sensor or step-count error, missing usage or health data, revoked permissions, battery optimization, offline periods, or time zone issues, and our determination of an outcome is final.
• These features are not available everywhere. We may limit, disable, or geo-restrict staking features where local law requires it.

7.3 Subscriptions

• Subscriptions are billed by Apple or Google at the price and billing period shown when you buy, and they renew automatically unless you cancel at least 24 hours before the next billing period.
• Cancel in your Apple or Google account settings—deleting the App does not cancel a subscription. Canceling stops future renewals; it does not refund the period you are already in.
• If a free trial is offered and you do not cancel before it ends, the paid subscription starts automatically.
• We will give notice of a price change before it applies to you. If you do not want to accept it, cancel before the next renewal.
• When a subscription ends, premium features stop working. Coins or items you already received are not affected.

8. Friends, Social Features, and User Content

8.1 Social Features

• You may add friends, send/receive friend requests, engage in rivalry features, and message where enabled.
• You can block users. We may restrict social features for accounts that violate these Terms.

8.2 Your Content

• "User Content" includes your goals, messages, profile info, and any text/media you submit.
• You retain ownership of your User Content, but you grant RageFit a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely to operate, improve, and provide the App.
• You represent that you have the rights to submit your User Content and that it does not violate law or third-party rights.

8.3 Other Users Are Not Us

• What other users say and do—their messages, roasts, hijacks, motivational messages, profiles, and claimed goal results—is theirs, not ours. We do not create, pre-screen, or endorse it, and to the maximum extent permitted by law we are not responsible or liable for the conduct of any user, on or off the App.
• Anything that happens between you and another user, including duels, challenges, pledges, and fallings out, is between the two of you. We are not a party to it, although we may act under Section 5.2 if these Terms are broken.
• If someone crosses a line, block them and tell us. If you feel unsafe or threatened, contact your local authorities—we are not an emergency service and cannot step in in real time.

9. Data Collection and Privacy

Your use of the App is governed by our Privacy Policy, which explains what we collect and how we use it. By using the App, you consent to the collection, use, sharing, and processing of data as described in the Privacy Policy.

10. Disclaimers

• The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.
• We do not guarantee that you will achieve any goals or outcomes.
• Device integrations depend on your device, permissions, OS support, and third-party services; accuracy may vary.
• Social features depend on other users' behavior; we do not guarantee safe or respectful conduct by others.

10.1 Physical Activity, Health, and Safety

• Check with a professional first: RageFit pushes you toward movement, step targets, and other physical goals. Talk to a doctor or another qualified health professional before you start or change an exercise program, especially if you are pregnant, injured, recovering from illness, or have a heart, joint, breathing, or other medical condition.
• You confirm that you are well enough for the activity you choose to do, that you are doing it voluntarily, and that you decide how hard to push. The App only sets reminders and tracks results; it does not assess your health or prescribe exercise.
• Stop straight away if you feel pain, dizziness, chest discomfort, or shortness of breath, and get medical help if you need it. Do not use the App while driving, and stay aware of traffic and your surroundings while you are moving.
• Streaks, stakes, deadlines, and roasts are motivational devices, not instructions. Never override your own judgment, your body, or medical advice because the App is nagging you or because coins are at stake.
• To the maximum extent permitted by law, you accept the risk of injury, illness, or loss arising from physical activity you choose to do in connection with the App. This does not limit our liability for death or personal injury caused by our own negligence (see Section 11.2).

11. Limitation of Liability

• To the maximum extent permitted by law, RageFit and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of your use of the App.
• Where liability cannot be excluded under applicable law, it is limited to the minimum permitted.

11.1 Cap on Our Liability

To the maximum extent permitted by law, our total liability to you for all claims arising out of or relating to the App or these Terms will not exceed the greater of (a) the total amount you paid for the App, virtual items, or subscriptions in the 12 months before the claim arose, or (b) NZD 50.

11.2 What We Do Not Exclude

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law. That includes liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, and any rights or guarantees you have as a consumer under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, or under the equivalent consumer protection laws of the country where you live. Where a limit in these Terms is not permitted, it applies only to the extent that it is.

11.3 Claims Caused by You

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless RageFit and its operators against third-party claims, demands, losses, and reasonable legal costs arising out of:

• Content you send or post, including roasts, hijack messages, and motivational messages you send to other users
• Your conduct toward another user, or any dispute between you and another user
• Your breach of these Terms or of any law, or your infringement of anyone else's rights
• Your use of monitoring or device-data features on a device or a person you were not authorized to monitor

We will tell you promptly about any claim we want covered, and we will not settle it in a way that creates an obligation for you without your agreement. This section does not apply to the extent the claim is caused by our own breach or negligence, and it does not apply where the law does not allow it.

12. Termination

• You may stop using the App and/or delete your account at any time.
• We may suspend or terminate access if we reasonably believe you violated these Terms, pose a risk to other users, or misuse the App.
• Termination does not entitle you to refunds except where required by law/platform policies.

13. Changes to the Service and Terms

• We may modify the App (including features, virtual items, and availability) at any time.
• We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of laws principles.

14.1 Sorting Out Problems

• Email us first at ragefitftw@gmail.com and give us 30 days to try to resolve the issue informally. Most things can be fixed this way.
• If that does not work, the courts of New Zealand have non-exclusive jurisdiction. If you are a consumer, this does not remove your right to bring a claim in the courts of the country where you live or to rely on the consumer laws that apply there.

14.2 General

• If any part of these Terms turns out to be unenforceable, it is narrowed or removed only to the extent needed and the rest of the Terms stay in force.
• If we do not enforce a right immediately, we do not give it up.
• The sections on virtual currency, disclaimers, limitation of liability, indemnity, and governing law keep applying after your account is closed.
• These Terms and the Privacy Policy are the whole agreement between you and us about the App. Headings are for convenience only.
• We may give you notices in the App, by push notification, or by email to the address on your account.
